Art 1 – Scope of Application

These General Terms and Conditions of Sale (“T&Cs”) apply, without restriction or reservation, to all sales concluded by the seller with non-professional buyers (“the clients” or “the client”), wishing to purchase the products offered for sale (“the products”) by the seller on the website kitelab.fr. The products offered for sale on the site are as follows: outdoor sports items, kites, construction games.

The main characteristics of the products, in particular the specifications, illustrations and indications of dimensions or capacity, are presented on the website kitelab.fr.

The client must review this information before placing an order.

Our comments & advice are available for each product to facilitate your choices.

The choice and purchase of a product are the sole responsibility of the client.

Product offers remain valid within the limits of available stocks, as specified when placing the order.

These T&Cs are accessible at any time on the website kitelab.fr.

The client declares having read these T&Cs and accepted them by ticking the box provided for this purpose before initiating the online ordering procedure on www.kitelab.fr.

Unless proven otherwise, the data recorded in the Seller's computer system constitute proof of all transactions concluded with the client.

Art 2 – Orders

It is the client’s responsibility to select on the website kitelab.fr the products they wish to order, according to the following procedure:

The client selects a product, adds it to their cart, which they can delete or modify before validating the order and accepting these terms and conditions of sale. The client then fills in their details and chooses the delivery method. After validation, the order is considered final and requires payment by the client according to the terms provided.

Product offers are valid as long as they are visible on the site, within the limits of available stock.

The sale will only be considered valid after full payment of the price. It is the client’s responsibility to check the accuracy of the order and report any errors immediately.

Any order placed on the website kitelab.fr constitutes a distance sales contract between the client and the seller.

The seller reserves the right to cancel or refuse any order from a client with whom there is a dispute regarding payment of a previous order.
Art 3 – Prices

Products are supplied at the current prices listed on the website kitelab.fr when the order is recorded by the seller.

Prices are expressed in Euros (€), VAT included.

Prices take into account any discounts granted by the seller on the website kitelab.fr.

These prices are firm and non-revisable during their period of validity, but the seller reserves the right, outside the validity period, to modify prices at any time.

Prices do not include processing, shipping, transport, and delivery fees, which are charged additionally under the conditions indicated on the site and calculated before the order is placed.

The amount payable by the client corresponds to the total purchase amount, including these fees.

An invoice is issued by the seller and delivered to the client upon delivery of the ordered products.

Some orders may be subject to a prior estimate, valid for 30 days from the date of issue.
Art 4 – Payment Terms
The price is paid by secure payment methods, as follows:

The price must be paid in full by the client on the day the order is placed.

Payment data is encrypted using the protocol defined by the approved payment provider handling banking transactions on the site kitelab.fr.

Payments are only considered final after actual receipt of the sums due by the seller.

The seller will not deliver the ordered products if the client has not paid the full price.
⚠️ Note: an item marked as available on the day you place your order may no longer be available on the day we receive payment and process the order.
Art 6 – Delivery

Products ordered by the client will be delivered in mainland France, Europe, and internationally. Delivery consists of transferring physical possession or control of the product to the client.

Deliveries in mainland France take place within 5 business days at the address indicated by the client.

Deliveries in Europe take place within 8 business days.
-
International deliveries take place within 8 to 17 business days.

The seller will make every effort to deliver within the specified timeframes, but these are provided for information only.

Availability displayed is indicative only and does not constitute a contractual commitment. If there is an error, we will inform you by email or phone within 6 business days from the order date.

Unless you request otherwise, orders are shipped complete. If an item is unavailable, the entire order will ship once all products are available. You may request partial shipment of available items, but additional shipping charges will apply for each shipment.
Art 6 – Transfer of Ownership

Transfer of ownership of the products from the seller to the client will only take place after full payment, regardless of the delivery date.
Art 7 – Right of Withdrawal

If you are not fully satisfied with a product, you have 14 days from delivery to return it.

Returns must be made in original packaging, complete (accessories, instructions, etc.), in resaleable condition, accompanied by proof of purchase.

Incomplete, damaged, used, or soiled items will not be accepted. In particular, kites that have flown even once will not be taken back. Return shipping costs and risks remain the client’s responsibility.

Accepted returns will generate either a credit or a refund (upon client’s request) after verification.
⚠️ Exception: according to French Consumer Code (Article L121-20-2), the right of withdrawal does not apply to customized or made-to-order products.

Exchanges (subject to availability) or refunds will be processed within 14 days of receipt of the returned products.
Art 8 – Product Information

Despite our best efforts to ensure accuracy, product descriptions, photos, and specifications may contain errors. Corrections will be made as soon as possible.

We cannot be held responsible for changes made by manufacturers. Photos are non-contractual. Prices, descriptions, and colors are for information only and may vary depending on supply and market conditions.

Products comply with French law. We are not liable if products do not comply with the laws of the destination country. It is the client’s responsibility to check with local authorities before ordering.
Art 9 – Liability

KiteLab cannot be held responsible for any damages, material or immaterial, resulting from misuse of products.

In particular, for kites and accessories, KiteLab disclaims liability if safety recommendations are not followed:

Choose a safe, open area
-
Stay away from power lines, trees, roads, and water
-
Do not fly over people
-
Avoid airports, power plants, and stormy weather
-
Use equipment appropriate to the user’s size and ability
-
Always follow manufacturer’s instructions and use safety accessories

And above all: apply common sense at all times.

Art 10 – Intellectual Property

The content of the website kitelab.fr is the property of the seller and protected by French and international intellectual property law.

Any reproduction, even partial, is strictly prohibited and may constitute infringement.
Art 11 – Personal Data

The client is informed that collection of personal data is necessary for sales and delivery, handled by the seller. This data is collected solely for the execution of the sales contract.
Art 12 – Environment

Whenever possible, KiteLab reuses all supplier packaging to prepare and ship orders.
-
This helps reduce waste and protect the environment. We also choose carriers based on their environmental commitment and lowest-impact solutions.
